There is an important distinction between the two types of custody that are recognized by California law.
Legal custody refers to the right of a parent to make major life decisions on behalf of the child, such as decisions involving health care, religious upbringing and education. Typically joint and shared custody agreements grant legal custody to both parents.
Physical custody refers to the actual physical residence where the child will be spending his or her time. Another term that is associated with physical custody is visitation. The court’s goal is to maximize the time that the child or children spend with each parent, with the belief that doing so is in the best interests of the child. The schedule does try to take into account the child’s schooling, extracurricular activities, each parent’s work schedule, etc. Health and safety concerns are also taken into account when the court makes orders for visitation.
